Når hybridkanaler utfordrer : En analyse av TV2 og P4, og deres forhold til kringkastingsloven og konsesjonsvilkår i perioden 1992-2002 og 1993-2003

Abstract

Denne oppgaven tar for seg hvordan de to første kommersielle riksdekkende allmennkringkasterne i Norge fant seg til rette på det kommersielle markedet, og forholdt til de statlige myndighetene. I analysen drøfter jeg hvordan TV 2 og P4 forholdt seg til kringkastingslovverket og konsesjonsvilkårene. Jeg har vektlagt de konkrete lovbruddene, utnyttelse av skjønn i lovtekstene og oppfyllelsen av allmennkringkastingsbetingelsene, for å undersøke hvordan utfordringene har påvirket myndighetenes syn på kommersielle kringkastere. Jeg undersøker TV 2 og P4 separat, for deretter å gjøre en komparativ analyse av dem. Undersøkelsesperioden er den første konsesjonsperioden, for TV 2 det vil si fra 1992 til 2002 og for P4 er det fra 1993 til 2003. Mot slutten av analysen diskuterer jeg den nye konsesjonsrunden i 2001/ 2002 og forsøker å se utfallet i sammenheng med funnene i min analyse.

This study looks at how the two first commercial, national broadcasters in Norway established themselves on the market, and their relationship with the national government. In the analysis, I discuss how TV 2 and P4 have acted in accordance with the Broadcasting Act and their license conditions. I have placed weight on the violations of the law, how the parties have interpreted the bill at their discretion, and how the broadcasters have fulfilled the conditions laid out in their licenses, in order to answer how this has affected the government s view on commercial broadcasters. I investigate TV 2 and P4 separately, and then conduct a comparative analysis of the two. The timeframe under investigation is the first period under license. For TV 2, the first period runs from 1992 till 2002, whereas it runs from 1993 till 2003 for P4. Towards the end of the analysis, I discuss the second license round in 2001-2002, and examine the results of the round in connection to the findings of this thesis.
