Abstract
Norge er gjennom EØS- og Schengen-medlemskapet en del av det europeiske fellesskapet, og er sterkt berørt av både den regulære og den irregulære strømmen av mennesker over grensen. Som i resten av Europa, jobbes det også her med utvikling av systemer for kontroll av reisende på vei over den norske grensen, som er en del av Schengens yttergrense. I likhet med andre Schengen-land har også Norge tatt i bruk sentrale felleseuropeiske datasystemer. Systemene har som formål å sikre kontroll over bevegelser av snart alle grupper av personer på vei over Schengen-grensen, men er hovedsakelig rettet mot borgere av ikke-europeiske land - enn så lenge. I det nåværende politiske klima er flere innstramningene på vei, og de gjelder ikke nødvendigvis bare tredjelandsborgere. Tema for denne masteroppgaven er undersøkelse av et IKT-basert datasystem som norsk politi bruker i forbindelse med gjennomføring av grensekontrollen. Systemet heter Grensekontroll, og som oftest er omtalt forkortet som GK. Hovedformålet med masteroppgaven er å bidra til spredning av kunnskap om den norske grensekontrollen, og om utforming og bruk av GK i grensekontrollens kontekst. Jeg skal vurdere hvorvidt GK tjener sitt formål som er å bidra til effektiv og sikker gjennomføring av grensekontrollen. I tillegg skal jeg diskutere noen prinsipielle spørsmål angående GKs utforming og behandling av personopplysninger av de reisende i systemet.
Norway is through the EEA and Schengen membership a part of the European community, and is strongly affected by both the regular and the irregular flow of persons across its border. As in the rest of the Europe, also here an effort is made to develop computer systems for control of travelers making their way across the Norwegian border, which is a part of the Schengen external borders. Like other Schengen countries, also Norway is making use of important, common European computer systems like VIS and SIS II. The systems are designed to ensure the control of the movements of soon all groups of persons crossing the Schengen borders, but are mainly aimed at the citizens of non-European countries - for the time being. In the current political climate, characterized by crisis and concerns about migration, terrorism and transnational crime, coupled with mass tourism in an accelerating growth, the more restrictive measures are on the way, and they will not necessarily apply only to the third country nationals. The theme of this thesis is an examination of an ICT-based computer system that Norwegian police uses during the control of the persons at the border. The system is called Grensekontroll (Border control), and is mostly referred to as GK. The main aim of the thesis is to contribute to the spread of knowledge about the Norwegian border control, and about design and use of GK in the context of the border control. I shall examine whether the GK serves its purpose, which is to contribute to the efficient and safe execution of the border control. In addition, I will discuss some fundamental questions regarding GK design and processing of personal data of the travelers in the GK.
