Abstract
”Matrikkel” betyr liste (over fast eiendom). Etter matrikkellova av 2005 er det landets kommuner som har ansvaret for føringen av matrikkelen. Fremstillingen handler om det offentliges kompetanse på det matrikulære felt, med den klassiske forvaltningsrett som det teoretiske fundament. Hovedtema er kommunens kompetanse til å rette/endre/tilføye eksisterende matrikkelopplysninger (matrl. § 26), og partens anledning til å påberope seg kompetansemangler gjennom klage (matrl. § 46). Et særlig spørsmål som behandles, er i hvilke situasjoner føringsvedtak må forhåndsvarsles, og på hvilket tidspunkt parten får klagerett. I denne sammenheng blir varslingsbestemmelsen i matrl. § 26, 4.ledd vurdert nærmere i lys av enkeltvedtaksbegrepet.
Matrikkel means a list (of property). According to the law of land registration from 2005, municipalities are responsible for the (day to day) implementation of the land register. The presentation is about the public sector's powers in the matricular field, with the classic administrative law as the theoretical foundation. The main theme is the municipality's authority to correct, amend or add information to the existing one (matrl. § 26), as well as the party's opportunity to claim that the authorities have exceeded their power (matrl. § 46). A particular issue under consideration is in what situations the decision of correcting information must be notified in advance, as well as at what time the party may file a complaint. In this context, the notification provision in matrl. § 26, 4.ledd, is considered further in light of rules concerning individual decisions.
